Hamburg HBauO 2026: Permit‑free homes, heat pumps, EV chargers, balcony PV

Since 1 January 2026, Hamburg’s HBauO makes small residential buildings, heat pumps, EV chargers and balcony PV permit‑free—subject to conditions. What qualifies, and what paperwork is still required.

What changed on 1 January 2026

Hamburg replaced and reorganised its building‑code procedures with a new Hamburgische Bauordnung (HBauO) effective 1 January 2026. The Senate and the city’s building authority confirm two key shifts: (1) many small residential projects move to a Genehmigungsfreistellung (permit‑exempt after submission) under HBauO § 62, and (2) several energy‑ and mobility‑related installations become verfahrensfrei (fully permit‑free) under HBauO § 61 and its Annex. The city’s press notice explicitly highlights that smaller residential buildings, heat pumps, EV charging stations and balcony solar are covered from 2026.([hamburg.de](https://www.hamburg.de/resource/blob/1127896/119cabfcbb456a1a2d1df3ff2cbf59c4/2025-11-27-gesamtsynopse-hbauoalt-hbauoneu-farbig-data.pdf))

Crucially, “permit‑free” in Hamburg now has two flavours: - Genehmigungsfreistellung (§ 62): you submit the plans (“Bauvorlagen”); if the authority does not call in a permit within one month, you may build. - Verfahrensfrei (§ 61 + Annex): no building permit and no submission to the building authority—yet all other public‑law requirements still apply.

All statements below refer to the HBauO text in the official synoptic comparison for the version applicable from 1 January 2026.([hamburg.de](https://www.hamburg.de/resource/blob/1127896/119cabfcbb456a1a2d1df3ff2cbf59c4/2025-11-27-gesamtsynopse-hbauoalt-hbauoneu-farbig-data.pdf))

Small residential buildings under § 62 HBauO (Genehmigungsfreistellung)

Eligible projects are listed in § 62(1): - New residential buildings of building classes 1 and 2 without underground garages; and freestanding residential buildings of building class 3 without underground garages. Ancillary structures and rooms for liberal professions (per BauNVO § 13) are included. - Alterations that create such buildings. - Converting attics to residential use and adding dormers on those buildings.([hamburg.de](https://www.hamburg.de/resource/blob/1127896/119cabfcbb456a1a2d1df3ff2cbf59c4/2025-11-27-gesamtsynopse-hbauoalt-hbauoneu-farbig-data.pdf))

Conditions in § 62(2): the plot must either lie within a binding local plan (Bebauungsplan) and fully comply with it, or—in built‑up areas governed by BauGB § 34—meet the other prerequisites. In all cases, (i) servicing (“Erschließung”) must be secured, (ii) the site must not lie in an area covered by a conservation regulation under BauGB § 172, and (iii) the authority must not call in a permit within the one‑month review window.([hamburg.de](https://www.hamburg.de/resource/blob/1127896/119cabfcbb456a1a2d1df3ff2cbf59c4/2025-11-27-gesamtsynopse-hbauoalt-hbauoneu-farbig-data.pdf))

Exclusions: § 62(1) second sentence excludes special buildings (Sonderbauten), advertising installations, and very large housing additions that create over 5,000 m² of residential gross floor area within a Seveso industrial safety distance.([hamburg.de](https://www.hamburg.de/resource/blob/1127896/119cabfcbb456a1a2d1df3ff2cbf59c4/2025-11-27-gesamtsynopse-hbauoalt-hbauoneu-farbig-data.pdf))

Process, timeline, fee: You submit the Bauvorlagen digitally; if no contrary notice arrives within one month, you may start. Hamburg states a €150 fee per Genehmigungsfreistellung case. Since 1 January 2026, procedure switching is no longer provided for.([hamburg.de](https://www.hamburg.de/service/info/111255615/n0/))

What is fully permit‑free under § 61 HBauO (Annex)

Balcony and façade PV: Solar systems are verfahrensfrei when installed in, on or on top of roofs and on balcony parapets (except on high‑rises), and on exterior walls of buildings in classes 1–3. Ground‑mounted solar up to 3 m height and up to 9 m overall length per boundary is also verfahrensfrei.([hamburg.de](https://www.hamburg.de/resource/blob/1120142/7ddedf29455d81ad575e5cec6f047cf9/2025-11-12-gesamtsynopse-hbauo-2005-hbauo-2025-data.pdf))

Heat pumps: Heat pumps “nach § 6 Absatz 8 Satz 1 Nummer 4” are explicitly listed as verfahrensfrei in the Annex.([hamburg.de](https://www.hamburg.de/resource/blob/1120142/7ddedf29455d81ad575e5cec6f047cf9/2025-11-12-gesamtsynopse-hbauo-2005-hbauo-2025-data.pdf))

EV charging infrastructure: The Annex lists EV charging installations as verfahrensfrei (including minor technical elements of charging infrastructure). Associated transformer stations are covered when not constituting buildings or when up to 3 m high and up to 15 m² gross floor area in industrial, commercial or special zones.([hamburg.de](https://www.hamburg.de/resource/blob/1120142/7ddedf29455d81ad575e5cec6f047cf9/2025-11-12-gesamtsynopse-hbauo-2005-hbauo-2025-data.pdf))

Front gardens: Hamburg newly allows, in principle, EV charging equipment and heat pumps in front‑garden strips of residential streets provided at least half the front‑garden area remains landscaped and the street image is preserved.([hamburg.de](https://www.hamburg.de/resource/blob/1120142/7ddedf29455d81ad575e5cec6f047cf9/2025-11-12-gesamtsynopse-hbauo-2005-hbauo-2025-data.pdf))

Important: Even if verfahrensfrei, the HBauO states that all other public‑law requirements still apply and the authority may enforce compliance.([hamburg.de](https://www.hamburg.de/resource/blob/1127896/119cabfcbb456a1a2d1df3ff2cbf59c4/2025-11-27-gesamtsynopse-hbauoalt-hbauoneu-farbig-data.pdf))

Paperwork you still need

For § 62 Genehmigungsfreistellung you must submit “Bauvorlagen” to the district building authority. Hamburg provides the one‑month timeline and a stated €150 fee per case. The content of the Bauvorlagen is governed by the Bauvorlagenverordnung (BauVorlVO). Since 2026, Section 3 “Klimaschutz” of the BauVorlVO requires you to include documents proving whether your project triggers and fulfils Hamburg’s PV obligations under the Hamburgisches Klimaschutzgesetz (HmbKliSchG) §§ 16 and 16a (roof and car‑park PV duties). Use the city’s guidance for what to file.([hamburg.de](https://www.hamburg.de/service/info/111255615/n0/))

For balcony PV, the building authority’s FAQ confirms these are verfahrensfrei. However, listed buildings or areas under § 172 BauGB still need separate consent (monuments under § 9 DSchG; conservation areas under § 172 BauGB). Ensure your balcony guard height and fire‑safety remain compliant after mounting.([dokumente.hamburg.de](https://dokumente.hamburg.de/resource/blob/190362/9fd6e7fa2030b18ea099ede2bbcc1b58/faq-balkonkraftwerke-data.pdf))

For EV chargers, building law may be permit‑free, but grid law still applies. In Germany, chargers above 11 kW require prior approval from the network operator; most installations must at least be notified. Hamburg’s DSO requires controllability for loads above 4.2 kW under the nationwide “steuerbare Verbrauchseinrichtungen” regime. Check the operator’s portal before ordering equipment.([bundesnetzagentur.de](https://www.bundesnetzagentur.de/DE/Fachthemen/ElektrizitaetundGas/Netzanschluss/start.html?utm_source=openai))

Technical proofs under HBauO: Even without a building permit, you must comply with structural safety, fire safety, thermal and acoustic requirements. Where a project goes through § 62, prepare the standard technical proofs (“bautechnische Nachweise”) per HBauO § 68 and the BauVorlVO; the authority or the appointed structural checker can request and review them.([hamburg.de](https://www.hamburg.de/resource/blob/1127896/119cabfcbb456a1a2d1df3ff2cbf59c4/2025-11-27-gesamtsynopse-hbauoalt-hbauoneu-farbig-data.pdf?utm_source=openai))

Boundaries, neighbours and risk points

Distance rules and neighbours: If you need a formal deviation (Abweichung) from distance‑area rules (Abstandsflächen), neighbour consent is required under HBauO § 69; the new text clarifies that the standard 2.50 m minimum depth triggers consent if undercut, subject to the specific exceptions that include § 6(8) sentence 1 no. 4 for heat pumps. Do not count on a deviation without written neighbour consent.([hamburg.de](https://www.hamburg.de/resource/blob/1120142/7ddedf29455d81ad575e5cec6f047cf9/2025-11-12-gesamtsynopse-hbauo-2005-hbauo-2025-data.pdf))

Front‑of‑plot placement: While front‑garden allowances were expanded to include chargers and heat pumps, the garden must remain at least 50% landscaped and the street image preserved. Expect checks in conservation areas.([hamburg.de](https://www.hamburg.de/resource/blob/1120142/7ddedf29455d81ad575e5cec6f047cf9/2025-11-12-gesamtsynopse-hbauo-2005-hbauo-2025-data.pdf))

Procedural pitfalls: Starting work before the one‑month § 62 window lapses is risky; the authority can still require a permit or prohibit works. Hamburg also notes that changing procedure after 1 January 2026 is not foreseen—choose your track carefully with a local architect (Bauvorlageberechtigte).([hamburg.de](https://www.hamburg.de/service/info/111255615/n0/))
